There have been more case law and findings where there are allegations that the U.S. Department of Health and Human Services of Civil Rights and the U.S. Department of Justice has found at times that DCF has discriminated; including, against a developmentally delayed mother, by assuming that she was unable or unsafely on how to parent her daughter because of her disability.

There was the conclusion that DCF refused to offer the mother appropriately family based services; failed to modify DCF’s policies, practices and procedures and that the mother’s disability was the reason the goal was changed.

There is a letter dated January 29, 2015, that explains the allegations and it finds that there are some systematic issues with DCF. It has become a hotter topic in terms of issues with disabilities for parents in DCF or in care & protection cases.
