DCF is prohibited from a Disability Based Discrimination; which includes denial of opportunities to benefit different services and failure to reasonably modify its policies procedures and imposing methods of administration that have the effect of discriminating on the basis of disability.

There has been found, including public letters by the US Department of Justice and US Department of Health and Human Services that are public letters to DCF, but essentially DCF if a disability, including a developmental disability is part of the case, the Department has fairly stringent requirements in terms how they are supposed to avoid discriminating against the person with the disability and what they need to do to comply with the law.

This is something that should be carefully examined by the parties in the case and maybe part of the litigation; or part of what you try and get to get services for the family. It is a relatively complicated area, but the jest of it is that DCF cannot discriminate based on disabilities and it be a major part of many DCF cases; particularly, if they are allegations of developmental disabilities or a claim of developmental disabilities.
