Deseration is a cause of action that is in a divorce called “utter deseration” for one year.  It is rare that this cause of action is met.  Moving out has many factors and may be one of the most important early decisions in a divorce.  It may make it harder for the other spouse to have to move out or agree to sell the house but there are many factors that have to be examined inclduing children and custody and if there are issues of domestic violence.  You should speak to a lawyer to get the legal pro’s and con’s before making a decision.
