The answer is it depends. There are many fair hearing officers that ask specifically not to have a memo written when asked. There are some fair hearing officers that ask for a memo to be written and there are some fair hearing officers that will leave it to the discretion to the attorney.

Memos are usually, but not always something that I would recommend but other than the cost of having it done as it can highlight aspects of the fair hearing that took place.  It can talk about specific exhibits and detailed areas of the law that sometimes can help in the fair hearing officer’s decision making normally by him/her but to also go over that with their supervisors.
