There appears to be a proposed agreement in Massachusetts between the defense attorneys and the DA’s office because of the breathalyzer test problems since 2015 with some of the flaws.  A great deal of the breathalyzers was shown to have flaws and showing to have issues with the evidence.  It is not yet approved by the Courts and it is not yet exactly clear how many drunk driving convictions could be reversed.  It may allow re-trials of cases without the breathalyzer.  It is important if you do have a conviction for an OUI where a breathalyzer test was involved to at least keep abreast of what is going on with the possibility of seeking a new trial.
