You have to show that there a valid order that the Defendant had knowledge and knowledge of the conditions.  You should also check to see if there has been a modification of the restraining order in Probate and Family Court; which occurs frequently and/or if there are any other agreements or attachments. It is important to look at all the details of the restraining order.

There are also some defenses; including if the contacts are either inadvertent or accidental.  For an example, if the parties are in the same court house that would not necessarily be a violation of the restraining order and would be incidental.  If the defendant started talking that might in fact be a violation in terms of accidental contact it might be not planning but seeing other side; again, having more conversations with the plaintiff or after accidentally seeing them at one location continuing going back to that location might be problematic and a violation of the restraining order.
