A Conditional Custody is such that the Judge can find that there is enough evidence to support DCF’s request for temporary custody, but can also decide if there can be conditions put in place where the child(ren) can be returned to the parents or custodians. They can include general conditions as allowed in probation; a court investigator; or the children’s counsel to come to the home for the parents to comply with DCF service plan and to a variety of other conditions; including, agreeing to know if drugs, alcohol or random screens can also include not allowing certain people in the home. It includes supervisions of a variety of different aspects; which is something that is seen more and more often when parents are successful at the 72-hour hearing in order for the parents to regain custody.
