It depends.  This is something that would be advantageous to a least get a copy of the records if you are able to.  There are ways that attorneys can subpoena some of the records and some of the therapeutic records for the child if there is a valid therapist patient privilege you might need a special Guardian Ad Litem to determine whether to waive the child’s privilege or not.  It is important to try and gather potentially whether they are school records, IEP records, Pediatric records, ABA records, early intervention records or daycare records and so forth.  The records may be relevant to a custody or parenting plan issues depending on the circumstances.
