If there is shared physical custody of the child or even if the child spends a lot of time with the other parent, it does make it a more difficult burden to be able to move out of state. This would be best interest standard vs. the Yannas standard. So, it is not the real advantage, it is solely about what is in the child’s best interest, and it is much more difficult to get there if the child has a strong relationship with both parents in that situation. If there is a real advantage to the parents seeking to move out of state, that will no longer control things for the court, the court will look more to protect the child’s relationship with both parents.
